Equitable Distribution of marital property

All property acquired during a marriage is considered to be the property of the parties jointly, regardless of how it is titled, unless an exception applies.  In the simplest term when this “marital property” is divided either by Agreement or by the Court, it is commonly referred to as “Equitable Distribution”. 

It is important to note that equitable distribution does not mean equal distribution.  The Court will consider numerous factors in determining how to equitably divide your property.  There are no clear rules when it comes to division of property, in one situation receiving 50% of the martial estate might be a great deal, while in another it might grounds to sue your lawyer for malpractice.  It’s important that you (and your lawyer) know the difference.
