Separation Agreements

In Pennsylvania there is no specific step that must be taken in order to legally separate from your spouse.  Under the law, separation is defined generally as “the cessation of the marital relationship”.  However, in some cases it makes sense for parties to enter into agreements clearly stating that they are separated, and even defining some of the terms of their separation including temporary child support, spousal support or custody.  Agreements like this can be helpful in moving a case toward a conclusion, and making the process of being “married but separated” easier on everyone. 

However, it is possible (not even uncommon) for one party to try and sneak prejudicial language into a separation agreement to hurt their spouse later in the divorce.  For this reason it’s important to have the Agreement reviewed by separate counsel even if your spouse presents it to you and tells you, “there is nothing to worry about”.
