Protection from Abuse (PFA)

Few areas of family law can be more difficult to deal with than Protection From Abuse Litigation.  In cases where a protection from abuse is an issue, it often boils down to one overarching statement; A PFA action is essentially one adult, telling another adult, that they don’t want to see them anymore.

While resolving a PFA matter is difficult, it is important to note that the vast majority of PFA cases do settle.  This is not because all accusations are false, or even inflated, it is because once both parties accept the premise noted above, the nature of the allegations can become less important.  Indeed, even if the abuse allegation is strong, if there are no children involved, and the offending party agrees to move out and cease all contact an Order can be entered that will facilitate that agreement, and a hearing becomes unnecessary.

Of course, as with all domestic relations litigation, where children are involved the issues become more complex.  Even though a PFA is in place, an offending party is still entitled to see their children.  However, if the allegations are serious, the offending party may be required to have supervised visitation pending further review of the Court, but arrangements to maintain the parent child relationship must still be made.

If you’re considering filing for a PFA Order, or if you have been served with a temporary PFA Order scheduling a hearing in 7 to 14 days, it is important that you discuss your options with a lawyer so you are armed with the knowledge necessary to know the strengths and weaknesses of your case, as well as possible outcomes and the effect they can have on not only your relationship with your children, but also on your job, criminal record and ability to work in the future.  My office has experience representing both sides in PFA litigation, and I will work with either the plaintiff or the defendant to ensure that their rights are protected.
